Agreement to Terms. This End User License Agreement ("EULA") is a legal agreement between you and CASINO NIAGARA POCKET PASS LTD for the Casino Niagara Pocket Pass software application. By installing, copying, or using the App, you agree to be bound by the terms of this EULA. If you do not agree, do not install or use the App.
By using Casino Niagara Pocket Pass, you acknowledge that you have read, understood, and agree to be bound by this EULA and our Privacy Policy. This EULA governs your use of the App and supplements our Terms & Conditions.

The App is licensed, not sold. CASINO NIAGARA POCKET PASS LTD retains all right, title, and interest in and to the App, including all intellectual property rights therein. This EULA does not grant you any rights to trademarks, service marks, or trade dress of CASINO NIAGARA POCKET PASS LTD.
All software code, algorithms, designs, interfaces, graphics, text, branding, and other content in the application.
Your personal guest data and preferences that you provide or that are generated through your use of the app.
Your use of the App is also governed by our Privacy Policy. Casino Niagara Pocket Pass stores guest data — including your login session, stay information, loyalty details, and preferences — locally on your device. This data is not transmitted to external servers in the current version of the application.
You are responsible for maintaining the security of your device and for all activity that occurs through the App on your device.
The App is provided "as is" without warranty of any kind. To the maximum extent permitted by applicable law, CASINO NIAGARA POCKET PASS LTD disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free from defects. Casino Niagara Pocket Pass is a guest services companion tool and does not guarantee access to any physical property, amenity, or service beyond the functionality described within the app.
To the maximum extent permitted by applicable law, in no event shall CASINO NIAGARA POCKET PASS LTD be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of the use of or inability to use the App.
This includes, but is not limited to, damages for loss of access, data loss, inconvenience, or any other loss arising from a failure of the digital pass or app functionality.
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from CASINO NIAGARA POCKET PASS LTD if you fail to comply with any term of this EULA. Upon termination:

CASINO NIAGARA POCKET PASS LTD may provide updates, patches, or modifications to the App from time to time. These updates may be delivered automatically through the Apple App Store. You acknowledge that updates may be required for continued proper functioning of the App.
We reserve the right to modify this EULA at any time. Continued use of the App after changes constitutes acceptance of the modified EULA. We encourage you to review this page periodically.
This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which CASINO NIAGARA POCKET PASS LTD operates, without regard to its conflict of law provisions. Any disputes arising from this EULA shall be resolved through the applicable legal channels in that jurisdiction.
